This position will report to the Senior Compliance Manager and is responsible for the Company's successful execution of several key areas of our day-to-day compliance program including, but not limited to:
- Supporting the leadership of DaVita's Home National Team and Home operators, as well as DaVita's Patient Education and Physician Experience teams, as part of a compliance team that supports these businesses.
- Leveraging data and analytics to identify, assess, and mitigate compliance risks, and to drive continuous improvement in the compliance program.
This person will provide compliance guidance and support to the teams above on compliance-related matters, including federal and state fraud and abuse laws (with emphasis on the False Claims Act and Anti-Kickback Statute), and other health care regulatory requirements as such matters arise in the context of Home dialysis services, patient education, physician experience initiatives, and related business activities. This person will partner with internal clients to develop, enhance, and sustain compliance program elements for projects related to health care regulatory laws and regulations. ESSENTIAL DUTIES AND RESPONSIBILITIES
- Interprets and applies the Anti-Kickback Statute, the False Claims Act, and other health care compliance requirements to business operations and initiatives.
- Assists in annual risk assessment process across the Home Dialysis, Patient Education, and Physician Experience teams, including using data insights to prioritize high-risk areas and developing action plans and timelines for mitigation.
- Oversees development, modifications, communications, and implementation of policies and procedures related to Home Dialysis, Patient Education, Physician Experience, and other compliance-related topics.
- Assists in development and delivery of compliance communications to key stakeholders.
- Designs and implements compliance training (e.g., annual compliance training, new policy training) with a focus on practical application, data-informed trends, and emerging risk areas.
- Collaborates with other compliance teammates to develop and execute monitoring plans, including data-driven analyses of business operations to identify patterns and proactively flag risk.
- Oversees the development and implementation of compliance monitoring and auditing for Home Dialysis, Patient Education, and Physician Experience teams in partnership with the Senior Compliance Manager, incorporating analytics to detect patterns and proactively identify risk.
- Collaborates with internal audit teams to design an annual audit plan for the business, ensuring FCA and AKS risks are prioritized.
- Partners and collaborates with senior leadership and legal counsel to develop compliance guidance on all new and current business initiatives.
- Partners with compliance teammates, regulatory attorneys, business attorneys, IT, finance, accounting, and business clients to identify and resolve compliance matters, ensuring solutions are practical, data-supported, and risk-informed.
- Monitors changes in relevant regulatory areas to assess compliance program gaps and proposes improvements supported by data and trend analysis.
- Manages special projects as needed.
- Minimal travel required.
MINIMUM QUALIFICATIONS
- Bachelor's degree required; JD/CPA/MBA or other relevant advanced degree or certification preferred.
- Experience in the health care industry and knowledge of health care fraud and abuse laws and regulations, including the Anti-Kickback Statute, is required.
- Minimum of 3-5 years' experience as a legal or compliance professional responsible for the development, implementation and sustainment of an effective compliance program.
- Demonstrated project management experience, including ability to develop and deliver project plans and timelines to senior leadership.
- Demonstrated ability to present and communicate effectively with executive management, business leaders, and field employees.
- Proven track record of collaborative problem solving with senior management and business leaders to achieve business goals.
- Superior writing and communication skills.
- Prior experience with providing legal/regulatory advice to health care providers preferred.
- Prior experience working under or advising clients related to a CIA/DPA or other state/federal regulatory oversight is beneficial.

The Salary Range for the role is $82,000.00-$121,000.00 per year.
